Privacy Policy

This Privacy policy covers the use of the web site operated by Smashion LLC (collectively, "us", "we", "our", "Smashion" or "the Company") and located at www.smashion.com and the services provided through the web site (collectively, "the Site"). At Smashion we take user privacy seriously and make reasonable efforts to protect your privacy. This document describes how we collect and use the personal information you decide to share.

Effective Date

This Privacy Policy is effective as of April 15, 2009.

Collection of Personal Information

We will not sell or disclose your name or email address to third parties without your explicit consent, except as specified in this Privacy Policy.

When registering with Smashion, you will be asked to provide certain personally identifiable information such as username, email address, geographic location and other similar information for the purpose of completing the registration process. In order to use certain portions of the Site, you will be asked to provide additional personal information such as Paypal account.

We collect information volunteered by users such as survey information and information that you provide on your profile page.

If you communicate with us via email regarding the Site, we may collect the email address and any information that you provide to us in any such communication.

Collection of Non-Personal Information

Like most other web sites, we uses analytic and reporting technologies to record non-personal information when you access the Site, including but not limited to: Internet domain and host names, Internet protocol (IP) addresses, browser information, operating system information, clickstream patterns, the URL of the previous web site you visited, your ISP, and the dates and times that the Site and its services are accessed.

Information Security and Protection

The security of your personal information is important to us. We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Whenever we obtain your Personal Information, we use commercially reasonable efforts to protect it from unauthorized access or disclosure. However, we are not an insurer of the security of your Personal Information. Accordingly, we assume no liability for any disclosure of data due to errors in transmission, unauthorized third party access or other acts of third parties, or acts or omissions beyond our reasonable control.

The content that you store, post, or transmit on or through the Site, such as forum postings, your profile page, and images you upload to the Site, may be accessed by other users, including people that you do not know. We are not responsible for the actions of others. Therefore, you should use care in communicating with other users and only disclose your Personal Information to other users that you know to be trustworthy. You should not assume that your content will be kept private.

Information Sharing and Disclosure

When you post a message, your username and ID is visible to other users. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. We may be required to disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service. We may disclose personally identifiable information to parties in compliance with our Copyright Policy, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity. We may share aggregated demographic information with business partners.

We are affiliated with a variety of businesses and work closely with them. We may also provide services or sell products jointly with affiliated businesses. Due to the nature of our business model, when an affiliated business is associated with your transaction, you will share customer information that is related to such transaction with that affiliated business.

We employ other companies and people to perform tasks on our behalf and needs to share your information with them to provide products and services to you. Examples include but are not limited to fulfilling orders, handling billing disputes and collections, analyzing data, providing marketing assistance and providing customer service.

We will not rent, sell, or share personal information about you with nonaffiliated parties except as specified in this Privacy Policy to provide products or services you have requested or when we have your permission. It may be necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Terms of Service, as specified in this Privacy Policy or as otherwise required by law.

We may disclose your Personal Information to any successor-in-interest of Smashion, such as a company that acquires Smashion. In the event we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of the assets, your personally identifiable information will likely be among the assets transferred. You will be notified via email or by a notice on the web site of any such change in ownership or control of your personal information.

As part of interacting with other users on the Site, you may obtain their email addresses and other personal information. Pursuant to the Terms of Service, you have a limited license to use this information. This information should only be used for Smashion-related communications or for Smashion-facilitated transactions. We have not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any Smashion user to your email or physical mail list.

Without limiting the above, We will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order, legal process, or substantially similar legal procedure, except when We believes in good faith that the disclosure of information is necessary to protect our rights, prevent imminent physical harm or financial loss, or to report suspected illegal activity.

Third Parties

Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are users on the Site or throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. Smashion does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

You may be able to access third-party web sites directly from the Smashion web site. This Privacy Policy does not apply when you access such web sites. We cannot control how third parties may use Personal Information you disclose to them, so you should carefully review the privacy policy of any third-party web site you visit before using it or disclosing your Personal Information to its provider.

Cookies

A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site's computers and stored on your computer's hard drive. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. If you reject all cookies, you will not be able to log in and to use or to take full advantage of some of our services. We use our cookies primarily for the purpose of improving your online experience with us. For example, we use a persistent cookie that stores encrypted information about your account login (but not your actual password or username or email address) to make it easier for you to login when you come back to the Site. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature. We do not collect personal information through cookies, nor do we combine information collected through cookies with other personal information.

Third Party Advertising

Advertisements that appear on Smashion are sometimes delivered (or "served") directly to users by third party advertisers. They automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of their ads and to personalize advertising content. Doing this allows the advertising network to recognize your computer each time they send you an advertisement in order to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. Smashion does not have access to or control of the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on Smashion unless you choose to share it with them.

This privacy policy covers the use of cookies by Smashion and does not cover the use of cookies or other tracking technologies by any of its advertisers.

Changing or Removing Information

You can change your personal and profile information through the editing tools after you log into your account. Information will be updated immediately. Certain account information (for example, username and email) cannot be changed after the account is created because it is used to uniquely identify a user.

You may delete or deactivate your user account by sending an email to support@smashion.com. We will respond to your request within 7-14 business days. When your account is deactivated or deleted, the personal and profile information on your account and any content you uploaded to the gallery will be removed too. Removed information may persist in backup copies for a reasonable period of time but will not be generally available to Smashion users.

Certain content such as the forum posts you made and personal messages you sent to other Smashion users generally cannot be removed.

Inviting and Sharing

If you choose to use our invitation service to tell a friend about our site, we will ask you for information needed to send the invitation, such as your friend's email address. We will send your friend an email in your name inviting him or her to visit the site, and may send follow-up reminders to them. We store this information to send invitations and reminders, to register a friend connection if your invitation is accepted, to allow you to see invitations you have sent, and to track the success of our referral program. Your friend may contact us at support@smashion.com to request that we remove this information from our database.

"Share" (also known as Tell a Friend on other web sites) is a feature that allows users (including registered users and unregistered users) to share information about a specific item or page on the Smashion web site by sending a personalized email message. We will ask for the information needed to send the message, such as your friend's email address and your email address if you are not a registered user. We will then automatically send your friend an email, inviting your friend to visit the site. We do not store on our servers any information about this message, including your friend's email address, the personalized note and your email address if you are not a registered user with us.

Communications from Us

We may occasionally email you service-related announcements that are not promotional in nature. You may not opt out of this type of communications from us.

We will send you other email communications in relation to the use of the services on the Site. For example, we will send you a confirmation email when you sign up for an account; we will email you instructions for resetting your password; we will send you a notice when someone requests to be your friend. Certain communications are required for continued service from us (such as resetting password) and cannot be opted out. For other emails, you may opt out from your account page, though we reserve the right to send you notices about your account even if you opt out of all voluntary email notifications.

Children Under Age 13

We have no intention to collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for Smashion or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on Smashion. In the event that we learn that we have collected personal information from a child under age 13 without verification of such child's parent or guardian's consent, we will use all reasonable efforts to delete such information from our database.

Children Between the Ages of 13 and 17

We insist that users between the ages of 13 and 17 should be under their parents' or legal guardian's supervision while using the Site to ensure their privacy.

Changes to Privacy Policy

We may make changes to this Privacy Policy from time to time. We will notify you of any changes by posting a notice here or on part of the Smashion web site or by sending you an email. You must review the new privacy policy carefully to make sure you understand our practices and procedures before continuing to use the Site.
